MAINTENANCE PAYOUT MUST TO WIFE EVEN IF SHE’S RICH: BOMBAY HIGH COURT


The Bombay High Court said that the husband cannot deny his wife’s interim maintenance on the grounds that her parents are rich and affluent or that her parents are in a position to maintain her. While holding that a wife’s independent income cannot by itself justify denial of interim maintenance to her, the court set aside a Mumbai family court’s 2016 dismissal of a woman’s plea on these grounds, and directed the husband, who had initiated proceedings before the family court, to deposit arrears of roughly 72 lakh towards maintenance within two months.
