The Bombay High Court said that the husband cannot deny his
wife’s interim maintenance on the grounds that her parents are rich and
affluent or that her parents are in a position to maintain her. While holding
that a wife’s independent income cannot by itself justify denial of interim
maintenance to her, the court set aside a Mumbai family court’s 2016 dismissal
of a woman’s plea on these grounds, and directed the husband, who had initiated
proceedings before the family court, to deposit arrears of roughly 72 lakh
towards maintenance within two months.
